Broker found to be engaged in misleading conduct

The Australian Securities and Investments Commission (ASIC) has banned a mortgage broker from engaging in credit activities and providing financial services after he engaged in false and misleading conduct.

Following an investigation, ASIC found that Queensland-based broker Driss Doukari provided false documents to Suncorp-Metway Limited in support of a home loan application in his own name in September 2011.

"Mr Doukari's conduct was not inadvertent nor was it the result of a momentary lapse. It was dishonest conduct committed knowingly and deliberately," commissioner Peter Kell said.

"He failed to have regard for the principles applicable to a person engaging in credit activities, and his conduct was aimed at gaining an advantage for himself and his friends."

The fraudulent documents Mr Doukari provided included payslips and bank statements.

At the time of the conduct Mr Doukari, from Bundaberg, was an employee of Brisbane-based mortgage broking business Dynamic Finance Solutions.
